A.  The RMD Model Amendment does not have to be completed until the end of 2003 even if the final regulations are used in 2002.

      To Complete the Model RMD Amendment:

In Section A insert the date in 2002 or 2003 when the final RMD regulations were first used.

Completion of Sections B, C & D is Optional.  These sections apply to situations in which the participant has died before required distributions have begun.

Complete Section B if the Plan will provide the designated beneficiary with the option for the 5-year rule in addition to the beneficiary having the life expectancy option.

Complete Section C to permit the participant or beneficiary to elect the 5-year rule.

Complete Section D to permit a beneficiary who is already using the 5-year rule to switch to the life expectancy method provided the annual amounts that would have been required on the life expectancy method are all distributed by 12-31-03.  This is a transition rule that must be elected by 12-31-03.
